Product Standards
Electrical Service Products may sell circuit breakers in the following conditions, depending on price and customer requirements. Customers can receive information about the quality and condition of breakers at any time by contacting ESP.
New:
To the Seller's knowledge, the circuit breaker is in original receiving container and has not been installed or energized. Subject to the limitations set forth below, Seller guanantees that the circuit breakers will operate in a normal manner under competent supervision under normal load, usage and conditions for a period of one year from the date of sale.
Surplus New:
To the Seller's knowledge, the circuit breaker has never been energized or in service. Subject to the limitations set forth below, Seller guarantees that the circuit breakers will operate in a normal manner under competent supervision under normal load, usage and conditions for a period of one year from the date of sale.
Reconditioned:
To the Seller's knowledge, the circuit breaker may have been dismantled, inspected, cleaned, lubricated, reassembled, painted and certain parts replaced. Subject to the limitations set forth below, Seller guarantees that the circuit breakers will operate in a normal manner under competent supervision under normal load, usage, and conditions, for a period of one year from the date of sale.
Used:
To the Seller's knowledge, the circuit breaker may have been previously energized, installed, or used in an electrical system. Subject to the limitations set forth below, Seller guarantees that the circuit breaker will operate in a normal manner under competent supervision under normal load, usage and conditions, for a period of one year from the date of sale.
SELLER HEREBY DISCLAIMS ANY WARRANTY THAT THE GOODS ARE OF MERCHANTABLE QUALITY OR THAT THEY CAN BE OF USE FOR ANY PARTICULAR PURPOSE AND, EXCEPT AS PROVIDED HERINABOVE, FURTHER DISCLAIMS ANY OTHER WARRANTY, EXPRESS OR IMPLIED. SELLER SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES, LOST PROFITS, OR ANY OTHER KINDS OF DAMAGES ARISING OUT OF THE SALE OF THE PRODUCTS TO BUYER OR THE USE THEREOF. SELLERS LIABILITY FOR FAILURE OF THE PRODUCT TO OPERATE IN ACCORDANCE WITH THE ABOVE GUARANTEE IS LIMITED TO A RETURN OF THE PURCHASE PRICE TO THE BUYER OF TO THE REPLACEMENT OF THE PART PURCHASED AT THE OPTION OF THE SELLER.
The above guarantees do not apply to any defects, problems, or failure to operate resulting from the misuse by the buyer of the circuit breaker or any reassembly, repair, or reconditioning by the buyer of the circuit breaker subsequent to the sale by the seller.
